Where a Local Authority is under a duty to provide a service, they are responsible for doing so whether the property has an official address or not. It remains the case that even without a valid street naming and numbering decision, local authorities are still responsible for providing services (and in many cases are under a duty to do so). Where a service user demonstrates that they fall within one of the local authorities duties then it is considered that the local authority cannot refuse to provide services because a valid street naming and numbering decision has not (or not yet) been made in respect of the property where the service user is based.

For example, under the Section 45, Environmental Protection Act 1990, a duty is imposed on local authorities’ (who are waste collection authorities) “(a) to arrange for the collection of household waste in its area….and (b) if requested by the occupier of premises in its area to collect any commercial waste from the premises, to arrange for the collection of the waste”. It does not specify that the premise must have an official address and therefore waste should be collected whether there is an official address or not.
